| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | REASON FOR DECISION: Permission is sought to erect a first floor extension above a garage at Plot 4 McLean Road/High Street, Brotton. Plot 4 forms part of an infill development of four dwellings (2 pairs of semi detached houses) located on this prominent corner site. It is considered that the most appropriate policies of the Local Plan are GEN1, GEN2, H10, ENV1 and ENV4. Essentially where development falls within a conservation area, policy seeks to achieve a form of development that does not harm the special historic or architectural character of that area. Development should also respect the living conditions of nearby residential occupiers and not result in conditions prejudicial to highway safety or the crime prevention aims of the Local Plan. The development has commenced as a result of an earlier planning permission under reference R/2002/489/CA. This application seeks approval for a first floor extension above a garage, it would have a simple design reflecting the features of the approved building and with the ridge being lower than the ridge of the approved building would appear subordinate to it. No harm to the character or appearance of the conservation area is envisaged. With regard to the local residential amenity; the application property is adjacent to a terrace of properties where commercial uses can be found at ground floor. The property at 109 High Street has within its western flank a door at ground floor and window at first floor. The proposed addition would not so materially impact upon the living conditions of the occupiers of that property to warrant the withholding of planning permission. The design and distance from other property in such that no harm to other nearby residential occupiers is envisaged. The proposal does not raise concerns regarding either highway safety or crime prevention. |
| 3 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, H10, ENV1 & ENV4 were relevant to this decision. |
