# Condition Details
(1) The development to which the permission relates must be begun not later than: i) The expiration of five years from the date of the grant of outline planning permission, or ii) If later, the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON: Required to be imposed pursuant to Section 92 of the Town and Country Planning Act 1990.
(2) Approval of the details of the siting, design, and external appearance of the building(s), the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(3) The application site is on/close to land identified by the council as having a history of potentially harmful contamination. The applicant shall, prior to the commencement of any works involving the disturbance of the site, submit for the approval of the Planning Authority i) details of a suitable site investigation and risk assessment sufficient to identify the nature and degree of any contaminants in, on or under the site and the extent to which they may effect the suitability of the site for its intended use. ii) dependent on the findings of i) above, details of a suitable remediation scheme. The agreed scheme shall be implemented to the satisfaction of the Local Planning Authority prior to the development commencing. REASON: In the interests of public safety.
(4) The permission relates solely to the amended plans received on 22 June 2004. REASON: For the avoidance of doubt.
(5) New discharges of foul and surface water shall be on separate systems. REASON: To ensure a satisfactory form of development.
(6) Prior to the commencement of development a Community Use agreement shall be submitted and approved in writing by the Local Planning Authority. The plan shall include details of pricing policy, hours of use, managament and maintenance and provide details of access to the sports hall and changing facilities. The plan shall then be implemented upon commencement of development. REASON: To ensure that community use of the site is maintained.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H3 were relevant to this decision.
REASON FOR DECISION: The application is an outline application for residential development on the site of De Brus School. Redevelopment would take place when the new school at Brotton is operational. Originally the scheme involved the demolition of the Community Centre and Sports Hall but these have now been excluded from the application site. The site is within the limits to development and is essentially a brownfield site. Accordingly residential development on this site would be broadly acceptable in principle. The main issues relate to the loss of facilities as a result of demolition. Sport England no longer object on the grounds that the Sports Hall (which includes changing facilities) would be retained and the remaining playing field area is acceptable. Retaining the Sports Hall and Community Centre also overcomes some of the concerns raised by the Parish Council and Community Forum. The relocation of the facilities offered in the Virtual Learning Centre is a management issue rather than a planning issue and I understand that this is still under consideration. From a planning point of view the revised proposal is acceptable and I therefore recommend that the application be approved.
