# Condition Details
(1) The development to which the permission relates must be begun not later than: i) The expiration of five years from the date of the grant of outline planning permission, or ii) If later, the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON: Required to be imposed pursuant to Section 92 of the Town and Country Planning Act 1990.
(2) Approval of the details of the siting, design, and external appearance of the building(s), the means of access thereto and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(3) The permission relates solely to the amended plans received on 21 June 2004. REASON: For the avoidance of doubt.
(4) Before development commences a flood risk assessment should be undertaken and appropriate mitigation measures carried out the satisfaction of the Local Planning Authority. REASON: To ensure a satisfactory form of development.
(5) New discharges of foul and surface water must be on separate systems in accordance with details to be agreed with the Water Authority. REASON: To ensure a satisfactory form of development.
(6) There shall be no discharge of foul or contaminated drainage from the site into either ground water or any surface waters, whether direct or via soakaways. REASON: To prevent pollution of the water environment.
(7) No development approved by this permission shall be commenced until a scheme for the provision of surface water drainage works including flow attenuation has been submitted to and approved in writing by the Local Planning Authority. The drainage works shall be completed in accordance with the details and timetable ageed. REASON: To prevent the increased risk of flooding by ensuring the provision of a satisfactory means of surface water disposal.
(8) Prior to commencement of development of the site a community use agreement shall be submitted and approved in writing with the Local Planning Authority. The plan shall include details of pricing policy, hours of use, management and maintenance and shall be implemented upon commencement of development. REASON: To ensure a satisfactory form of development.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H3 were relevant to this decision.
REASON FOR DECISION: The application seeks consent to demolish the existing school when the new Freeborough College is built, and redevelop the site for residential purposes. The area to be developed comprises the site of the school buildings and associated hard surfaced areas to the north of the buildings. The site boundary has been amended so that all the site is within the limits to development as set out in the Council’s Local Plan and now excludes the woodland area to the east of the school which is designated as a site of Nature Conservation Importance. The application site is a “brownfield” site within the limits to development where new residential development is acceptable in principle. A small section of the northern eastern part of the site is within the indicative flood plan map and therefore a risk assessment will need to be undertaken before development commences to determine if any mitigation measures are required.
