# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) A roller shutter garage door shall be installed. REASON: In the interests of highway safety.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
REASON FOR DECISION:Permission is sought to construct a two storey side extension at 1 Kirkleatham Avenue, Marske a two storey semi detached dwelling located within an established residential area. It is considered that Policies GEN1, GEN2 and H10 of the Local Plan provide the basis for determining this proposal. These policies seek to achieve development that respects the character and appearance of the area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The application proposes a two storey side extension where currently a garage, store and utility exists. The design is simple and would complement the existing dwelling The application proposes a side gable rather than a hipped roof (as existing). It is considered that due to the location no harm to the character or appearance will result. With regard to local residential amenity; the proposed extension would be located on the north side of the property and would not extend any further rearwards than the existing building. A canopy over the new garage would extend forwards of the front face of the building at ground floor; the first floor would be level with the front face of the building. The extension would not therefore materially harm the living conditions of those neighbouring properties to the south, east or west. The property to the north west, 71 St Germains Lane will experience deeper overshadowing during the early part of the day. However, given the existing built form and level of overshadowing it is not considered that the additional overshadowing would be so great as to warrant a recommendation for refusal. In all other respects the development is acceptable. The application proposes a replacement garage together with the retention of the existing vehicle access and as such it is considered that the proposal would not compromise highway safety. This application does not raise concerns with regard to the crime prevention aims of the Local Plan.
