Conditions table
# Condition Details
1 (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) This permission shall enure for the benefit of Mr I Coles and for no other person. REASON: The permission is only acceptable having regard to the personal circumstances of the applicant.
3 (3) The use hereby permitted shall be discontinued and the land restored to its former condition on or before 31 March 2007, unless the prior consent of the Local Planning Authority has been obtained to an extension of the period of validity. REASON: The development is such that it would not be approved on a permanent basis in this location.
4 Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
5 NOTE: Redcar and Cleveland Local Plan Policies GEN1 & GEN2 were relevant to this decision.
6 REASON FOR DECISION: The applicant states that this proposal is very low key and does not involve the use of machinery and will create no noise nuisance. The premises have been inspected by Trading Standards, Environmental Health and Customs and Excise all of whom are satisfied. In order to sell the produce at fairs etc he requires an occasional licence and the only way to get that licence is to have a justices on licence which will be restricted to wine only and allows interested groups to visit and sample the wine by invitation only. I am of the opinion that the small scale nature of this facility which is focused on one particular product can be operated from these premises without prejudice to the neighbouring occupants which number no more than 5 properties including Ridley Terrace. The wine production is a ‘one man’ operation and by its very nature would be impossible to expand to a level that would cause concern. In the circumstances therefore subject to a condition restricting the use to Mr Coles only and on a temporary basis I consider the application acceptable
