(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) This permission relates only to the amended plan(s) received by the Local Planning Authority on 1 March 2004. REASON: For the avoidance of doubt.
(3) The external elevations of the extension shall be constructed in materials to match those of the existing building. REASON: In the interests of the appearance of the development in the locality.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision.
REASON FOR DECISION: Permission is sought for a front dormer window at 5 Oldham Close, Boosbeck, a semi detached bungalow located within an existing residential area and as such it is considered that Policies GEN1, GEN2 and H10 of the Local Plan provide the basis for determining the application. These policies seek to achieve development that respects the character and appearance of the area; that respects local residential amenity and that does not compromise highway safety or crime prevention. Firstly, with regard to the character and appearance of the area, other bungalows within the cul-de-sac have been extended by means of a flat roof dormer window within the front roof slope. As such it is considered that bearing in mind its location the current proposal would not be materially harmful to either the character or appearance of the area. Secondly, the application now seeks permission for a front former window only (the original application sought permission for both front and rear dormer windows; the applicants agent has advised that the rear dormer window will be built as “permitted development”). Given the distance between the proposed development and surrounding property no material harm to the living conditions of nearby residential occupiers is envisaged. The application does not raise concerns regarding either highway safety or crime prevention.
