6 NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, H3 & ENV4 were relevant to this decision.
7 REASON FOR DECISION: The proposal is a detailed application for the erection of two semi-detached properties on Marske Lane, Skelton. The site is within the limits to development; has its own road frontage and constitutes an infilling of a gap in a substantially built-up frontage. Accordingly the principle of developing the site for residential purposes is acceptable in principle. The site is also within the Skelton Conservation Area where new development should respect the character and appearance of the area. The proposed dwellings are of traditional design constructed in brick with pitched roofs in pantiles. The ground floor accommodation splayed bay windows with a canopy above the entrance door. The development is considered acceptable in terms of its location in the Conservation Area. The main issue with this application is the relationship with existing properties. Both the occupiers of the properties to the rear have expressed concern regarding the proposal. Discussions have taken place with the applicant and the proposal to provide turning areas to the rear of the new dwellings has been deleted. This will overcome issues of potential noise and nuisance referred to by the objectors. The floor levels of the proposed dwellings will be lowered to minimise the overall impact. Whilst this will result in a retaining wall (1.2 metres high) along the rear boundary, I do not consider that this will have an adverse effect on adjoining properties. Furthermore the dwellings have been repositioned slightly in order to achieve the minimum separation distance of 21 metres with the properties to the rear. The separation distance has been set to ensure that adequate lighting and a reasonable outlook /level of privacy are maintained. Whilst I accept the objectors concerns that previously they have enjoyed an open aspect from the rears of their properties, given the separation distance, the existence of a hedge along the rear and the fact that the properties will be stepped down across the site, I do not consider that any impact is sufficient to justify refusal of the application. Accordingly I would recommend that the application be approved.
