| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision. |
| 3 | REASON FOR DECISION: Permission is sought to construct a first floor extension on the south east side of 17 Barnes Wallis Way, Marske together with a new garage adjoining the north west side of the dwelling. 17 Barnes Wallis Way is a detached two storey dwelling within an established residential area located on the inside bend of the road midway between the junctions of Barnes Wallis Way with Folland Drive and Wellington Close. It is considered that Policies GEN1, GEN2 and H10 provide the basis for determining this proposal. These policies seek to achieve development that respects the character and appearance of the area; respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The proposed side extension has been designed to reflect the existing design of the building; whilst the garage is of a simple design. The front of the garage is proposed to project forward of the front face of the existing building by approximately 1 metre; this would be approximately 0.3 metres forward of the front canopy. However, given the varied street scene it is not considered material harm to the appearance of the street scene would occur. A gap approximately 0.9 metres would remain between the south eastern flank of 17 Barnes Walls Way and 15 Barnes Wallis Way. Further, given the juxtaposition of the two properties a ‘terracing’ effect would not occur. Bearing in mind the prevailing plot sizes and built form this proposal would not constitute overdevelopment. No harm to the character and appearance of the area is therefore envisaged. With regard to local residential amenity, the proposed first floor extension would be above the existing garage and utility room and would be approximately 0.9 metres from the boundary with 15 Barnes Wallis Road. The north western flank wall of 15 Barnes Wallis Way does not contain any windows. In common with similar houses in the area the existing utility room projects rearwards from the rear elevation by approximately 1 metre. This application proposes to extend above the utility and will therefore result in the first floor also projecting approximately 1 metre beyond the rear elevation. No windows are proposed within the side elevation of the first floor extension. There would be bedroom windows front and rear. Given the juxtaposition with neighbouring property it is considered that no direct overlooking and consequent loss of privacy would occur. Further given the juxtaposition with neighbouring property no material loss of light, overshadowing, domination or enclosure would occur. The proposed garage would be immediately adjacent to an existing garage at 19 Barnes Wallis Way. Given this and the distance from other neighbouring property no harm to the living conditions of nearby residential occupiers is envisaged. Overall no harm to local residential amenity is envisaged. With regard to highway safety; the application proposes that the existing access would be used. Access to the proposed new garage would require additional hardsurfacing at the front (this does not require planning permission). No harm to highway safety is therefore envisaged. This application does not raise concerns regarding the crime prevention aims of the Local Plan. |
