| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) The proposed development shall at all times remain ancillary to the use of the property as a single family dwelling house. REASON: In the interests of local residential amenity. |
| 3 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision. |
| 4 | REASON FOR DECISION: Permission is sought to extend 16 Beardmore Avenue, Marske a two storey residential dwelling located within an established residential area. It is considered therefore that Policies GEN 1, GEN 2 and H 10 of the Local Plan provide the basis for determining this proposal. These policies seek to achieve development that respects the character and appearance of the area; respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. Beardmore Avenue is a residential cul-de-sac comprising detached two storey dwellings and bungalows. The wider area also comprises a mix of two storey dwellings. 16 Beardmore Avenue is located at the northern extremity of a small spur; there are open fields to the north; a residential detached house to the south and a residential detached bungalow to the south west and open space to the east. The development has been designed to reflect and complement the existing dwelling. Taking into account the prevailing built form, where they are examples of garages adjoining site boundaries, the estate layout and design and the location of this property it is not considered that it would harm the character or appearance of the area. With regard to residential amenity; the proposed extensions and additions are restricted to the north western extremity of the property. The extended garage would reach the western boundary (that separates numbers 16 and 18 Beardmore Avenue); the resulting triple garage would have a new roof that would have three dormer windows within the south facing roof space and roof lights within the north facing roof space. The second storey addition would have north and south facing windows. All the south facing windows would face into the public and semi public areas of the cul-de-sac; the north facing window would face the open fields. Taking into account the location and proximity of neighbouring property it is considered that no overlooking or loss of privacy would occur. Due to the size, location and overall design there would be no undue domination, enclosure or overshadowing of neighbouring property. No harm to local residential amenity is therefore envisaged. The application indicates that the development is on land within the applicants ownership. Members will be aware that land ownership disputes are not planning matters. This proposal does not raise concerns with regard to either highway safety or crime prevention. |
