| 3 | REASON FOR DECISION:This is an existing hot food takeaway which has a restrictive condition attached excluding Sunday opening as required by Paragraph C of Policy SH 7 because of the close proximity of residential flats on the upper floors of this block of commercial properties. The applicant states that there are a number of other takeaways within the square in a similar situation that opens on Sundays and naturally he would like to do the same. On the basis that no representations have been received from the close residential occupiers and that other operators open on a Sunday which also includes the Social Club and a Bells Convenience Store, I consider it acceptable in this case to vary this condition to allow Sunday opening at the times stated. |
