| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) This permission relates only to the amended plan(s) received by the Local Planning Authority on 13 January 2004. REASON: For the avoidance of doubt. |
| 3 | NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2 and H10 were relevant to this decision. |
| 4 | REASON FOR DECISION: Permission is sought to extend 58 West Street, Normanby a two storey semi detached dwelling located within an established residential area. It is considered that Policies GEN1, GEN2 and H10 provide the basis for the determination of this proposal. These policies seek to achieve development that respects the character and appearance of the area; respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The proposed two storey side extension would have a simple design and would be set in from the side boundary. The property to the north is a bungalow. Terracing would not result. No harm to the character or appearance of the area is envisaged. With regard to local residential amenity, the proposed extension is restricted to the north side of the dwelling; the distance from dwellings to the east, west and south is such that no harm to the living conditions of the occupiers of those properties is envisaged. The bungalow to the north, 56 West Street has a kitchen window, front door and secondary lounge window within its southern elevation. The proposed side extension would not extend any further rearwards than the existing side garage and thus would not be opposite the side door or kitchen window. It will be opposite a secondary lounge window (the lounge having a large bay window at the front (east) of the bungalow. Given the juxtaposition of the two dwellings and the size and siting of the proposed development it is considered that no material harm to the living conditions of the occupier of 56 West Street will result. The application proposes to use the existing access and as such no harm to highway safety will result. This application does not raise concerns with regard to the crime prevention aims of the Local Plan. |
