| 4 | REASON FOR DECISION: Permission is sought to extend the residential curtilages of 5 properties at 37, 38, 39, 40 and 41 Hamilton Grove incorporating the rear footpath. The properties are located within a predominantly residential area. Members should note that the extension of the residential curtilages could only be implemented if the footpath closure order made under the Highways Act is confirmed by the Secretary of State. This procedure is being pursued by the Council as Highway Authority. The main considerations are those expressed by Policies GEN 1 and GEN 2 of the Local Plan. These policies seek to achieve development that respects the character and appearance of the area; respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. within an established residential area where the incorporation of the footpath into rear gardens would not be detrimental to the character or appearance of the area with regard to residential amenity; the proposed extension of the residential curtilages would not be detrimental to the living conditions of neighbouring occupiers. If approved, details of new fencing/walls would be required but this may be achieved by planning condition. No objections have been raised from a highway point of view. A safer alternative route is, however, being explored. The eventual closure of the footpath, if granted may reduce the incidences of crime within the close proximity to this site. The granting of the extension to the residential curtilages would not prejudice the crime prevention aims of the Local Plan. |
