# Condition Details
(1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
(2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(3) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(4) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(5) The proposed vehicular access and turning facilities shall be constructed concurrently with the dwelling houses. REASON: In the interest of highway safety
(6) Prior to the commencement of the development, details of the methods to be used to protect the existing trees on the site from construction work shall be submitted to and approved in writing by the Local Planning Authority, and such measures as approved shall be carried out before the development commences and maintained throughout the period of construction until the completion of the development. REASON: To ensure that existing trees/hedges on and adjacent to the site which are to be retained, are protected from vehicles and works involved in the construction of the development.
Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1, ENV35 & H3 were relevant to this decision.
REASON FOR DECISION: Members need to be aware that this site has in the past the benefit of planning permission for the erection of dwellings since 1976 and the latest of these consents was in 1990. An application for a nursing home and 30 person day centre was refused in the early 90’s. The site is within the Limits to Development as defined by the Local Plan as well as part (the western side) being within the Community Forest designation. Only development that does not accord with the policies contained within the Local Plan will be resisted within the community forest as implementation of the aspirations of the community forest can only be achieved through voluntary means. This scheme provides for ample parking together with a turning facility within the site and therefore will not impact further on the highway issues that exist outside the site along West Park Avenue, particularly during the start and finish times of the nearby school. I do not consider the two dwellings will add significantly to highway safety issues. As stated earlier part of the site is within the community forest and this is not a reason in itself to refuse a planning application however in this particular case the majority of the built area will be outside that boundary anyway. The site has not been maintained partially well for a long time and is heavily overgrown with undergrowth. Given that the Council have considered this site in the past capable of being developed and being within the limits to development I consider that the scheme is acceptable. However, with the implementation of any development comes the opportunity to improve the remainder of the site in respect of landscaping and this would fulfil the aims of the community forest by allowing for the planting of nature broad leaved species as well as the protection of the best of the existing trees.
