# Condition Details
1 (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990.
2 (2) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
3 (3) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
4 (4) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
5 (5) Details of the access arrangements for both customer vehicles and delivery vehicles shall be agreed with the Local Planning Authority before development commences. The new access roads shall be surfaced to the satisfaction of the Local Planning Authority prior to the country store use commencing. REASON: to ensure a satisfactory form of development.
6 (6) Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987, the building hereby approved shall only be used for the storage and the sale of the goods listed in the Schedule attached to this decision notice. REASON: Only the use as specified is acceptable in this location.
7 (7) Any signs on the building shall be the subject of a formal application to the Local Planning Authority. REASON: In the interests of the ammenities of the area.
8 NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1, AG2, ENV23, ENV24 & ENV28 were relevant to this decision.
9 REASONS FOR DECISION: The council consider that the proposal constitutes farm diversification and the scale of the development is appropriate in this location. The proposal is, therefore, in line with the Central Government advice and Policy AG2 of the Council's Local Plan. The new building will be located close to the existing farm buildings and will be an improvement visually on the existing situation. The intention to cease pig farming also is beneficial to the amenities of the area. Demolition and redevelopment of the existing site at North Skelton will greatly enhance the appearance of this area. The access arrangements subject to minor modification, are broadly acceptable and there are no highway objections to the proposal. There are no security issues associated with the proposed development since there is already an existing farmhouse on the site. The proposal therefore, accords with the Policies GEN1 & GEN2 of the Council's Local Plan.
