(1) The development to which the permission relates must be begun not later than: i) The expiration of five years from the date of the grant of outline planning permission, or ii) If later, the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON: Required to be imposed pursuant to Section 92 of the Town and Country Planning Act 1990.
(2) Approval of the details of the design, and external appearance of the building(s), and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Local Planning Authority before the expiration of three years from the date of this permission. REASON: To reserve the rights of the Local Planning Authority with regard to these matters.
(3) Details of materials to be used on the external elevations of the development shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. REASON: To ensure the use of satisfactory materials.
(4) This permission relates only to the amended plan(s) received by the Local Planning Authority on 2 March 2004. REASON: For the avoidance of doubt.
(5) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
(6) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
(7) Details of boundary walls and fences shall be submitted for approval in writing prior to the first occupation of the dwelling hereby approved. The approved scheme shall be implemented in its entirety prior to the first occupation of the dwelling hereby approved and thereafter be maintained. REASON: In the interests of visual and residential amenity.
(8) Before the development hereby approved is first brought into use, provision shall be made for the parking of two no. vehicles within curtilage of the site in accordance with a scheme to be agreed in writing by the Local Planning Authority and such provision shall thereafter be retained. REASON: To ensure that adequate on-site car parking provision is maintained.
(9) Vehicular access to the site shall only be gained from Dixon Street and from no other highway adjacent to the site. REASON: In the interests of highway safety.
Informative Note: The application site is on/close to land that has been identified as having a history of potential contamination. It is not considered that the development proposed will give rise to 'significant risk' to health or pollution of controlled waters. It is recommended, however, that the attention of the applicant be drawn to the risk of contaminants in, on or under the site.
NOTE: Redcar and Cleveland Local Plan Policies GEN1, GEN2, LD1, H3 & T6 were relevant to this decision.
REASON FOR DECISION: Outline planning permission is sought for a bungalow on land adjacent to 6 Dixon Street, Brotton. The site is within the limits of development, outside but adjacent to Brotton Conservation Area. It is considered that Policies GEN1, GEN2, LD1, H3 and T6 provide the basis for determining the current application where proposed development is within the limits of development those policies seek to achieve development that respects the character and appearance of the area; that respects local residential amenity and that does not compromise highway safety or the crime prevention aims of the Local Plan. The proposed site layout would due to the prevailing built form, the working mens club, residential terraces and detached single storey buildings would not prove harmful to the character and appearance of the area and would have a neutral impact upon the adjacent conservation area. With regard to local residential amenity, there are residential properties to the south east, south west and north east of the site. Parking is at a premium kerbside, however parking on site is proposed. A bungalow within the north western corner of the site with access from Dixon Street would be unlikely to result in undue loss of amenity to nearby residential occupiers. Parking is proposed within the curtilage of the application site. Whilst it is noted that there is a high demand for kerbside parking in Dixon Street due to its proximity to both High Street businesses and the club, as on site parking is proposed it is considered that the activity associated with one dwelling would not be so great as to warrant a recommendation for refusal on highway safety grounds. The application does not raise any concerns regarding the crime prevention aims of the Local Plan.
