| 1 | (1) The development shall not be begun later than the expiration of FIVE YEARS from the date of this permission. REASON: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990. |
| 2 | (2) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. | 3 | (3) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality. |
| 4 | (4) There shall be no deliveries to the site between the hours of 8:00pm and 07:00am Monday to Saturday and not at all on Sundays. REASON: In the interests of amenities of local residents. |
| 5 | (5) The drive through restaurant shall only operate between the hours of 07:30am and 10pm (Monday - Saturday) and 08:00am and 8:00pm on Sundays. REASON: In the interests of the amenities of the area. |
| 6 | (6) The existing wall along Hanson Street shall be retained and no pedestrian or vehicular access shall be created within this wall. REASON: For the avoidance of doubt and in the interests of the amenities of local residents. |
| 7 | (7) Before development commences details of the siting of the outlet flue shall be submitted to, and agreed in writing with the Local Planning Authority and thereafter installed in accordance with the approved scheme. REASON: To ensure a satisfactory form of development. |
| 8 | (8) The extraction system shall be installed and maintained to the satisfaction of the Local Planning Authority. REASON: In the interests of the amenities of nearby residents. |
| 9 | (9) The premises shall be used as a drive-through restaurant only and for no other purpose (including any other purpose within Class A3 of the Town and Country Planning [Use Classes] ) Order 1987. REASON: To reserve the rights of the Local Planning Authority with regard to this matter. |
