# Condition Details
1 (1) The development to which the permission relates must be begun not later than: i) The expiration of five years from the date of the grant of outline planning permission, or ii) If later, the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. REASON: Required to be imposed pursuant to Section 92 of the Town and Country Planning Act 1990.
2 (2) Approval of the details of the siting, design and external appearance of the buildings, the means of servicing and access thereto, the provision of car parking, the method of drainage, the land surface contours and the landscaping of the site (hereinafter called "the reserved matters") shall be obtained from Local Planning Authority before the expiration of 3 years from the date of this permission. REASON: To reserve the nights of the Local Planning Authority with regard to these matters.
3 (3) No development shall take place until there has been submitted to, and agreed in writing by the Local Planning Authority, a scheme of landscaping which shall include indications of all existing trees and hedgerows on the land (if any), and details of any to be retained, together with measures for their protection in the course of the development. REASON: To reserve the rights of the Local Planning Authority with regard to these matters
4 (4) All planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting and seeding season following the occupation of the buildings or the completion of the development, whichever is sooner, and any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species unless the Local Planning Authority gives written consent to any variation. REASON: To ensure the satisfactory implementation of the approved scheme in the interests of the visual amenities of the locality.
5 (5) No provision shall be made within the development for the parking or servicing of Heavy Goods Vehicles with the exception of vehicles servicing the development hereby approved. REASON: To ensure a satisfactory form of development.
6 (6) Before development commences details of the accesses on to Middlesbrough Road and the highway improvements along Middlesbrough Road including protected right turn facility, pedestrian refuges and footway and traffic calming measures shall be agreed with the Local Planning Authority and implemented in accordance with the agreed scheme prior to any of the uses hereby approved commencing. REASON: In the interests of highway safety.
7 (7) Before development commences details of the site levels of the proposed buildings shall be submitted to and agreed with Local Planning Authority. REASON: In order to reduce the visual impact of the development having regard to nearby residential properties.
8 (8) The mounding to the perimeter of the site shall not be altered without the prior consent of the Local Planning Authority. REASON: In the interests of the amenities of nearby residents.
9 (9) Before the development is brought into use details of the advances directional signing and internal signing shall be agreed with Local Planning Authority. REASON: To ensure a satisfactory form of development.
10 (10) The petrol filling station; drive through restaurant and public house shall not operate between the hours of 23.30 hours and 06:00 hours unless the prior consent of Local Planning Authority has been obtained. REASON: In the interests of the amenities of the area.
11 (11) New discharges of foul and surface water must be on separate systems and surface water run off must be prevented from entering the public foul or combined sewer. REASON: To ensure a satisfactory form of development.
12 (12) The full structural details of the installaiton, including the means of excavation, details of excavation, details of tank, its surround, associated pipework and monitoring system must be submitted to and approved by the Local Planning Authority prior to the commencement of work on the site. Thereafter all installation shall proceed in accordance with the approved details. REASON: To protect the groundwater quality in the area.
13 (13) Any facilities for the storate of oils, fuels or chemicals shall be sited on impervious bases and surrounded by impervious bund walls. The volume of the bunded compound should be at least equivalent to the capacity of the tank plus 10%. If there is multiple tankage, the compound should be at least equivalent to the capacity of the largest tank, or the combined capacity of interconnected tanks, plus 10%. All filling points, vents, gauges and sight glasses must be located within the bund. The drainage system of the bund shall be sealed with no discharge to any watercourse, land or underground strata. Associated pipework should be located above ground and protected from accidental damage. All filling points and tank overflow pipe outlets should be detailed to discharge downwards into the bund. REASON: To prevent pollution of the water environment.
14 (14) There shall be no discharge of foul or contaminated drainage from the site into either groundwater or any surface waters, whether direct or via soakaways. REASON: To prevent pollution of the water environment.
15 (15) Prior to being discharged into any watercourse, surface water sewer or soakaway system, all surface water drainage from parking areas and hardstandings shall be passed through an oil interceptor installed in accordance with a scheme previously submitted to and approved in writing to the LPA. Roof water shall not pass through the interceptor. REASON: To prevent pollution of the water environment.
16 (16) No development shall take place until details of a buffer strip between the development and Chapel Beck have been submitted to, and approved in writing by, the Local Planning Authority. The details shall include the landscaping arrangements. No part of the development shall be brought into use / occupied until the approved scheme has been fully implemented. The buffer strip shall thereafter be retained throughout the life of the development unless otherwise agreed in writing with the LPA. REASON: To protect ecological, recreation and amenity interests by providing a buffer between the development and the watercourse.
17 (17) No development approved by this permission shall be commenced until a scheme for the provision and implementation of a surface water run off limitation has been submitted to and approved in writing by of the Local Planning Authority. The scheme shall be implemented in accordance with the approved programme and details. REASON: To prevent the increased risk of flooding.
18 (18) No development approved by this permission shall be commenced until details of the use, handling or storage arrangements of any hazardous substance included in the Schedule to the Planning (Hazardous Substances) Regulation 1992 has been submitted to and approved by the Local Planning Authority. Thereafter the use, handling and storage arrangements shall take place at all times in accordance with the approved details. REASON: To prevent pollution of the water environment.
19 (19) Prior to the commencement of any works on site, a settlement facility for the removal of suspended solids from surface water run off during construction works shall be provided in accordance with details previously submitted to and approved in writing by the LPA. The approved scheme shall be retained throughout the construction period. REASON: To prevent pollution of the water environment.
20 (20) Roof drainage downwater pipes shall at all times be sealed at ground level to prevent the ingress of any contaminated water / run off. REASON: To prevent pollution of the water environment.
21 (21) Before development commences details of the lighting to the site and buildings, and all signage shall be submited to and agreed with the local planning authority and thereafter implemented in accordance with the agreed scheme. REASON: In the interests of the amenities of the area.
